I declare that I have read and understood

  1. That the Criminal Code (Ley 74-25, as amended by Ley 44-26) has been in force since August 2026, and that Ley 136-03 (the Code for the Protection of Children and Adolescents) remains in force (Art. 393, Ley 74-25; Art. 30, Ley 44-26) — Legal framework.
  2. That the law protects the student more strongly when the victim is a child or adolescent and when whoever causes harm holds authority over them or their trust (Arts. 119, 122 —text of 44-26—, 134 and 145, Ley 74-25) — Teachers.
  3. That a student under 13 is never criminally responsible, and that from the completed age of 13 and up to the day they turn 18, that day included, they answer before the criminal justice system for adolescents, with an educational purpose (Arts. 223, 225, 326, Ley 136-03) — Students.
  4. That the image, the personal details and the privacy of every student are protected, and that digital communication with students is only in groups and through institutional channels (Arts. 186 and 192 —the latter, text of 44-26—, Ley 74-25; Código de Ética — the MINERD Code of Ethics, Arts. 10 and 13 b) — Families.
  5. That reporting where there is knowledge or suspicion of abuse is a duty that protects me: whoever reports in good faith is exempt from liability, and failing to do so may be an offence (Art. 14, Ley 136-03; Arts. 196.3 and 325, Ley 74-25) — School leadership · The school.

I commit myself to

  1. Observing attentively and listening to every student without interrogating them or suggesting answers (Art. 16, Ley 136-03).
  2. Documenting in writing, with the date, what I see or what is confided to me, and preserving the evidence without altering it.
  3. Reporting to the school leadership and to Orientación y Psicología (the guidance and psychology service) where there is knowledge or suspicion, so that the matter is referred to the Ministerio Público (the public prosecution service) or CONANI (the National Council for Children and Adolescents) within the periods provided (Código de Ética, Art. 42).
  4. Accompanying the student with positive discipline and mediation, without corporal, collective or financial punishment (Ordenanza 05-2023 — the MINERD school-coexistence rules, Art. 26).
  5. Protecting the information: discussing each case only with those it concerns; never with the press or in messaging groups (Código de Ética, Art. 14 f).
  6. Keeping my relationship with students within the academic and educational sphere, through group and institutional channels (Código de Ética, Arts. 10 and 13 b).
